Although the best interests of children always come first in the context of a divorce, parties in a marital dissolution cannot avoid the importance of money issues. Assets and debts must be identified, then classified as separate or community, and, finally, properly divided. Support payments from one spouse to the other, both child support and spousal support, must be determined. These determinations may stay in place for years, so proper attention to, and evidence in support of, our client’s best interests are paramount.
When there is any appreciable time lapse between the date of separation of the parties and the divorce process, there are also reimbursement issues, since all income of the parties after the date of separation is separate income, yet many community property debts may be paid with these separate property earnings. Thus, reimbursements must be calculated and pursued.
In short, tracking money, both cash flow and total assets, requires careful attention in order to ensure that our clients receive their fair and legal share of the money generated by the parties.
